Andrew Wyman

Mr. Wyman was born in Oceanside, New York, in 1971. Mr. Wyman attended the State University of New York at Albany where he earned his B.A. in Business Administration with a double concentration in Finance and Management Information Systems. He received his J.D. from Fordham University in 1996.

Mr. Wyman is admitted to practice law in New York (1997), New Jersey (1997) and Florida (2000). He is also admitted to practice in the U.S. District Court, Southern District of New York (1997); U.S. District Court, Eastern District of New York (1997); U.S. District Court, Southern District of Florida (2005); U.S. Bankruptcy Court, Southern District of Florida (2005) and U.S. District Court, Middle District of Florida (2010).

Mr. Wyman’s practice concentrates in litigation and trial work relating to contract, business, real estate, construction, securities and community association issues, as well as lender liability, foreclosure, insurance and debt collection matters before state and federal courts, FINRA (formerly NASD) and the American Arbitration Association.

Mr. Wyman is proud to have represented a diverse group of clientele including banks, securities broker/dealers, community associations (condominium and HOA), building contractors, land developers, insurance companies, automobile parts manufacturers, city agencies, utility companies, universities and individuals. He joined our firm as a Partner in 2011 after having been the Managing Member of Mattlin & Wyman, PL.

Representative Cases and Case Results

LIABILITY DEFENSE

Defended industry-leading automotive seating systems manufacturer in product liability cases in multiple federal and state jurisdictions.

Defended university in “educational malpractice” claim.
Result: Obtained judgment as a matter of law for client.

Defended New York City natural gas utility provider in numerous lawsuits alleging various premises, construction and gas-line maintenance causes of action.

BUSINESS LITIGATION

Represented local law firm against its former client, a publicly traded corporation, to enforce the terms of a promissory note.  Bench trial in Federal Court, Southern District of Florida.
Result: Judgment obtained for $457,927.50.

Represented operator of local cable television system in lawsuit seeking royalty payments against national operator of cable television system. 
Result: Obtained confidential, favorable settlement for client.

Represented Saudi Arabian exporter of commercial and military aircraft parts against Florida consignee in causes of action for breach of contract, conversion, violation of Florida’s Deceptive and Unfair Trade Practices Act and civil theft.  Jury trial in Federal Court, Southern District of Florida.
Result: Jury verdict in the amount of $312,500.00, resulting in a judgment in favor of client in the amount of $424,163.58.

Obtained injunction for national distributor of home security systems and satellite TV services against third-party marketing company alleging violations of the CAN SPAM Act of 2003, Telephone Consumer Protection Act of 1991 and the Federal Do-Not-Call Act of 2003.

REAL ESTATE LITIGATION

Represented lending institution in numerous foreclosures of commercial and developmental properties.
Result: Foreclosure of over $11,000,000.00 in outstanding loans.

INSURANCE CLAIMS

Represented assisted-living facility against its insurer for property damage relating to Hurricane Frances and Hurricane Jeanne.  Jury trial in Federal Court, Southern District of Florida. 
Result: Jury verdict of $1,901,296.49.

Represented local non-profit organization against its insurer for property damage relating to Hurricane Wilma.  Claim reopened four years after the storm damage occurred. 
Result: Obtained six-figure settlement for client.

Represented television production company against its insurer for claim arising out of theft of valuable television production equipment by client’s employees.  Claim re-opened 3 years after the theft.
Result: Obtained over $58,000.00 for client.

CONSTRUCTION LITIGATION

Represented home-owner in construction defect case against nationally recognized home builder.  Defects led to continuous and repeated water infiltration issues.
Result: Obtained confidential, favorable settlement for client.

Represented mixed-use condominium association in lawsuit against developer and contractor claiming various construction defects to windows and staircases.
Result: Negotiated favorable settlement for client where developer agreed to repair and replace all defective components at no cost to client.
